Cable Modem Service If the Licensee chooses to provide a Cable Modem Service, then 1.1 The Licensee shall implement monitoring of the Cable Modem Service to determine actual load and shall provide sufficient capacity to provide good performance: (1) in the link between the Subscriber and the Licensee's Internet Point of Presence; (2) in the link between the Licensee's Internet Point of Presence and its Internet backbone connections; and (3) in the connections to the Licensee's backbone providers. 1.2 The Licensee shall implement technical provisions such as loop and echo tests to permit a customer or third party to diagnose and isolate Internet connection problems. 2. Internet Access Service If the Licensee chooses to provide an Internet Access Service via its Cable Modem Service, it shall provide the Internet Access Service with a minimum of constraints on customer usage, and in conformance with the following requirements: 2.1. Licensee shall carry all categories of Internet Protocol datagrams to and from any network port without restriction and with no restrictions on content or usage. Performance of datagram carriage shall be independent of source and destination address. Priority service, if offered, shall be similarly independent of source and destination address. 2.2. Notwithstanding section 2.1, the Licensee may, with no extra charge or discount, restrict source and target addresses, ports, and content or usage for a particular Subscriber if that Subscriber so specifically requests. 2.3. Nothing herein shall be interpreted to prevent the Licensee from setting rates that are dependent solely on the customer's volume of network usage, so long as such rates do not depend on source and target address, port, content, or usage. 2.4. The Licensee shall make no restrictions on the number of computers or Internet addresses assigned to one Subscriber, and Licensee will implement access protocols that allow the Subscriber to attach a local area network. The Licensee will make no restrictions that prevent the Subscriber from simultaneously receiving Internet service from other Internet access providers. 2.5. The Licensee may, in its customer contract, restrict resale of its services and transit of datagrams through customer equipment to other customers and Internet access providers. 2.6. Internet addresses, once assigned, shall normally be stable. If it becomes technically necessary to change a Subscriber's Internet address, the customer shall be given sufficient notice that the customer's activities not be disrupted. 2.7. The Licensee shall implement updated and new network-level Internet protocol standards as soon as practical after they are adopted in the Internet community. ------------------------------------------------------------------- [end]
