Carlos Moorhead (CA), chairman of the House Subcommittee on Courts and Intellectual Property, announced that a hearing would be held on June 8, 1995, on three new pieces of pending legislation that affect US Patent Laws. Hearings are held to get input from interested parties. Seven days were afforded to prepare, respond, and attend. Of the bills, the most important for the inventive community is: HR 1733, "Patent Application Publication Act of 1995" "Each application for patent, except applications for design patents and provisional applicationsllllshall be publishedllllas soon as possible after the expiration of a period of 18 months from the earliest filing date for which a benefit is sought...." This means 18 months after filing a patent application, it will be published for the world to see--issued or pending. If a provisional application is filed (that's the one that was provided for in GATT legislation on the theory that inventors didn't need an attorney and it would only cost $75) and a complete patent application is then filed 12 months later, a patent application could be published 6 months after filing.
