As it's easy to notice that a lot of american films (but not
all of them!!!) deal with trials, I was interested in seeing what
you could say about layers and a good layer should be. For us,
a good one seems to have to be convincing and to defend his/her
client.For you, there is something more : he/she should win the
trial. Anyway, the law is not much quoted, and I really wonder
why. Couldn't you tell me why ? Do you think a lawyer has to be
a liar, too ?
Salut Emmanuel, je pense qu'un bon avocat sait faire dire presque
ce qu'il veut aux lois. Je ne pense pas que ce doit etre un menteur
mais s'il veut gagner des proces et devenir celebre donc considere
comme un bon avocat, il doit savoir manipuler les opinions. Ceci
implique une part de mensonge bien que quelquefois, ils croient
vraiment a l'innocence de leur client...

Il est quelque peu amusant de remarquer le gouffre qui separe la vision qu'on a du systeme judiciaire ,au travers de medias et des films, et les remarques qui sont apportees a ce questionnaire. On a presque l'impression ici que le bon avocat est une personne sympathique, qui gagne toujours ses proces, et cela presque gratuitement! C'est tres surprenant. On en vient a se demander si un tel avocat existe vraiment!

think that the law tends to get a little fuzzy during trials
and most people lose sight of the real issue. americans tend to
associate lawyers with lieing and being immoral because their
job is to do anything to get their client free. you mentioned
that a good lawyer is one who wins the trial. i guess here the
better lawyer is the one who is a better liar :)
here is a quick deffinition of what a lawyer should be, in
my homble opinion, and from personal experience. First of all,
by lawyer we usually mean defense council, which is quite different
from prosecutor or judge, all of them deal with law but all have
different objectives. A good lawyer gets his/her objective. And
that usually is to get yout client the best deal possible, or
freedom. To do so you need to know the case down cold, as well
as all the laws and regulations, and even similar previous cases
surrounding that trial and manupulate it (read: lie to the jury)
in such a way to make your client look the best. I'll end this

Je suis étonnée de voir que pour vous un avocat
doit etre un bon menteur ! Pour moi il doit faire son possible
pour alléger la peine de son client tout en restant objectif,
il travaille quand même sous serment ! C'est pourquoi je
crois qu'un avocat doit etre intimement convaincu de l'innocence
de son client pour le defendre de la meilleure façon ,c'est
à dire réduire sa peine au maximum tout en restant
fidèle à ses convictions et son serment. by the
way, what did you think of the OJ Simpson case ? Do you think
he was guilty ? Do you think the press should be enabled to meddle
with such trials ? I am waiting for your answers .
