From the Web: The Supreme Judicial Court ruled that "barring an individual from the protections, benefits, and obligations of civil marriage solely because that person would marry a person of the same sex violates the Massachusetts Constitution." The court stayed the entry of judgment for 180 days "to permit the Legislature to take such action as it may deem appropriate in light of this opinion." "Marriage is a vital social institution," wrote Chief Justice Margaret H. Marshall for the majority of the Justices. "The exclusive commitment of two individuals to each other nurtures love and mutual support; it brings stability to our society. For those who choose to marry, and for their children, marriage provides an abundance of legal, financial, and social benefits. In return it imposes weighty legal, financial, and social obligations." The question before the court was "whether, consistent with the Massachusetts Constitution," the Commonwealth could deny those protections, benefits, and obligations to two individuals of the same sex who wish to marry. In ruling that the Commonwealth could not do so, the court observed that the Massachusetts Constitution "affirms the dignity and equality of all individuals," and "forbids the creation of second-class citizens." It reached its conclusion, the court said, giving "full deference to the arguments made by the Commonwealth." The Commonwealth, the court ruled, "has failed to identify any constitutionally adequate reason for denying civil marriage to same-sex couples." Yet, a group of legislators at both the state and national levels are mobilizing in defense of this judgement, attempting to add an amendment to the state and federal constitution which bans gay marriages. To prevent this setback from occurring, please write your state and national legislators immediately-- and encourage your friends to do so as well. The Human Rights Campaign and Massachusetts Freedom to Marry Coalition websites have links directly to your representative and form letters that you can click and send instantly. It only takes seconds and can make a world of difference. Check out the sites at www.hrcactioncenter.org/actioncenter/home.html and www.ftmmass.org. Do you have any idea what you are doing for spring break? Although it is only the middle of November, its about time to be thinking about Spring Break in March, 2004. We're a couple of friends from the University of Wisconsin who are organizing spring break trips for LGBT groups across the country. We've found that our age group (18-25 y.o. gay travelers) has been ignored by both gay-travel and youth tour providers. We've decided to do something about it and we've reserved a block of rooms for the last week of February and the month of March at a sweet hotel right across the street from the beach in hip and very (very) gay-positive South Beach, Miami. We're organizing our trips over the web since we're trying to reach students in colleges across the country, and we've been lucky to get a great deal on a spot in the Nov/Dec issue of XY. However, we wanted to personally extend the invitation to you in hopes of fostering the idea of a national, social, all-encompassing LGBT community. We would also be able to discount multiple rooms for groups such as yours. We've called ourselves BreakOUT because we're trying to break out of the norm and offer something unique and positive for our community. Check out our website at www.breakouttravel.com. Please feel free to contact me at steve.curtis@breakouttravel.com to get more information about this trip, the first organized gay spring break!!!
