Step 3:  Identify Relevant Information

Determine whether there are foreign nationals participating in the Research Project, either within or outside MIT.

 

Within MIT
In the case where a foreign national associated with MIT may be a member of the research team, under the current regulations there is no reason to be concerned about their access to equipment or technology; however, this may change if there are modifications to the treatment of “use” technology under the regulations.

Outside MIT
A foreign national who is not associated with MIT can raise a number of potential export control issues where the equipment or technology being shared is not in the public domain as the potential for a deemed export exists in that circumstance.

 

Thus, it is also necessary to determine whether equipment within MIT that may be a controlled piece of equipment is necessary for the performance of the Research Project, as well as whether it will be necessary to perform any of the research at a location off campus and thus out of range to qualify for the fundamental research exclusion.
